Acceptable Use Policy

This Acceptable Use Policy (the “Policy”) governs your access to and use of the Atomic Comics platform, including our websites, applications, storefront, reader, and related services (collectively, the “Services”), operated by Atomic Comics (“Atomic Comics,” “we,” “us,” or “our”). This Policy is incorporated into and forms part of our Terms of Service. By accessing or using the Services, creating an account, uploading content, or buying or selling through the Services, you agree to comply with this Policy.
1. Who This Policy Applies To
This Policy applies to every userof the Services, including: (a) creators, studios, publishers, and any person or entity that uploads, lists, sells, or distributes content (“Sellers”); (b) fans, readers, and buyers (“Buyers”); and (c) any visitor to the Services. You are responsible for all activity that occurs under your account and for ensuring that anyone acting on your behalf complies with this Policy.
2. Your Content and Intellectual-Property Responsibility
Atomic Comics is a marketplace for original, independently created comics. When you upload, publish, list, sell, or otherwise make available any comic, image, page, cover, artwork, text, character, trademark, or other material (“Your Content”), you represent and warrant that:
- you own all rights to Your Content, or you have obtained all licenses, permissions, releases, and consents necessary to upload, reproduce, distribute, publicly display, and sell it through the Services;
- Your Content does not and will not infringe, misappropriate, or violate the copyright, trademark, trade-dress, patent, publicity, privacy, moral, or other rights of any third party; and
- Your Content complies with this Policy and all applicable laws in every jurisdiction in which it is offered.
Uploading, listing, selling, or distributing content that you do not own or are not authorized to sell is strictly prohibited and will result in immediate and permanent termination as described in Section 7. This includes scanning, ripping, re-uploading, or reselling comics, manga, graphic novels, artwork, or characters created or owned by anyone other than you.
3. Prohibited Content
You may not use the Services to create, upload, store, list, sell, distribute, link to, or otherwise make available any of the following. This list is illustrative, not exhaustive.
3.1 Intellectual-Property Infringement (Zero Tolerance)
- Copyrighted works — including comics, manga, graphic novels, illustrations, panels, covers, scripts, fonts, music, or photographs — that you do not own or are not licensed and authorized to distribute or sell;
- Counterfeit goods, or content that infringes or dilutes any trademark, trade name, logo, or trade dress;
- Fan works, derivative works, or content depicting third-party characters or settings that you are not licensed to commercialize;
- Content that removes, circumvents, or disables copyright-management information, watermarks, or technical protection measures.
3.2 Illegal, Exploitative, or Non-Consensual Adult Material (Zero Tolerance)
- Child sexual abuse material (CSAM), or any content that sexualizes, exploits, or endangers a minor — including real, animated, drawn, illustrated, computer-generated, or written depictions. This is an absolute prohibition. We report such material to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement;
- Non-consensual intimate imagery (“revenge porn”), content created or shared without the consent of the persons depicted, hidden-camera or voyeuristic content, and deepfake or synthetic sexual imagery of real, identifiable people;
- Obscene material, content depicting non-consensual sexual acts, incest, bestiality, or sexual violence;
- Any sexual or adult content that is illegal in a jurisdiction where it is offered, or that violates the rules of our payment processors.
3.3 Other Prohibited Content and Conduct
- Content that is unlawful, defamatory, fraudulent, deceptive, or that promotes illegal activity;
- Content that incites, threatens, or promotes violence, terrorism, self-harm, or genocide, or that harasses, bullies, doxxes, or targets any person or group;
- Hate speech or content that promotes discrimination or hatred on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic;
- Malware, spyware, phishing, or code intended to disrupt, damage, or gain unauthorized access to any system or data;
- Spam, deceptive listings, artificially inflated sales, or manipulation of reviews, followers, or platform metrics;
- Content that unlawfully collects, discloses, or trades in personal or sensitive information.
4. Prohibited Businesses and Activities
Because payments on the Services are processed through Stripe, all Sellers are also bound by the Stripe Services Agreement, the Stripe Connected Account Agreement, and Stripe’s list of Restricted Businesses. You may not use the Services to offer, sell, or facilitate any restricted or prohibited business or activity, including, without limitation:
- intellectual-property-infringing or counterfeit goods or services (see Section 3.1);
- illegal or exploitative adult material or services (see Section 3.2);
- regulated or age-restricted products such as controlled substances, drugs or drug paraphernalia, weapons, ammunition, or tobacco;
- gambling, lotteries, or other games of chance for money;
- financial crimes, including money laundering, terrorist financing, pyramid or Ponzi schemes, and unauthorized sale of securities;
- any activity that violates the rules of the card networks or applicable financial regulations, or that is designed to evade sanctions or export controls.
5. Eligibility and Age Requirements
You must be at least 18 years old, or the age of majority in your jurisdiction, to sell on the Services or to access age-restricted content. You must provide accurate identity, business, and payout information, and you must keep it current. Providing false information, or attempting to conceal your identity to evade this Policy, is a serious violation.
6. Monitoring and Removal
We may, but are not obligated to, review, monitor, restrict, remove, disable, or refuse to display any content, and we may investigate any suspected violation of this Policy. We may remove content and suspend access at any time, with or without notice, where we believe in good faith that action is necessary to comply with law, protect users, protect our payment processors, or enforce this Policy.
7. Enforcement and Penalties
Violations of this Policy may result in a range of actions, including a warning, removal of content, delisting, withholding or reversal of funds, suspension, or termination of your account and access to the Services. We determine the appropriate response in our sole discretion, based on the nature and severity of the violation.
Immediate, Permanent, Lifetime Ban
The following violations result in immediate termination and a permanent, lifetime ban from the Services, with no right of reinstatement:
- Uploading, listing, selling, or distributing copyrighted or otherwise intellectual-property-infringing material that you do not own or are not authorized to sell; and
- Creating, uploading, storing, or distributing illegal adult material, including any content that sexualizes or exploits a minor (CSAM) or any non-consensual intimate imagery.
A lifetime ban applies to the individual and to any entity they control, and we may: permanently disable all associated accounts; refuse future accounts; cancel pending and future payouts and forfeit or reverse related funds; retain records as required by law; and report the violation and the violator to our payment processors, the relevant rights holders, NCMEC, and law enforcement. Attempting to circumvent a ban — for example, by opening a new account or using another person’s identity — is itself a violation and extends the ban.
We maintain a repeat-infringer policy: any user who is the subject of repeated, credible infringement notices will be permanently banned from the Services for life.
8. Copyright Complaints — Notice and Takedown (DMCA)
We respect the intellectual-property rights of others and expect our users to do the same. If you believe that content on the Services infringes your copyright, please send a written notice to our Copyright Agent at dmca@atomiccomics.com that includes all of the following:
- your physical or electronic signature;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material that is claimed to be infringing, with enough detail (such as a URL) to allow us to locate it;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
We will remove or disable access to allegedly infringing material in appropriate circumstances, and we will terminate the accounts of repeat infringers as described in Section 7. If you believe your content was removed in error, you may submit a counter-notification containing the elements required by applicable law. Submitting a knowingly false notice or counter-notice may expose you to liability.
9. Reporting Violations
If you become aware of any content or conduct that violates this Policy — especially intellectual-property infringement or illegal adult material — please report it immediately to abuse@atomiccomics.com. Reports concerning the exploitation of minors are treated as the highest priority and are escalated to law enforcement and NCMEC.
10. Cooperation with Law Enforcement
We cooperate with law-enforcement authorities and rights holders. We may preserve and disclose account information and content where we believe in good faith that doing so is required by law, necessary to prevent harm, or appropriate to investigate a violation of this Policy.
11. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after a change takes effect constitutes your acceptance of the updated Policy.
12. No Waiver; Severability
Our failure to enforce any provision of this Policy is not a waiver of our right to do so later. If any provision of this Policy is held to be unenforceable, the remaining provisions will remain in full force and effect.
