There have been a number of titles that have sold out at Diamond but are still available at retailers. Is it really sold out if copies are available? Should there be a ComicScan that reports actual sales like BookScan does for bookstores?

More then likley they ARE sold out. What you must have saw was the second print. Sometimes they like to play tricks on us...like how Buffy and Reprint Buffy had the same cover...>> And barcode.

Case One:  Ok....let me break it down....Newsarama....Big Announcement....Buffy the Vampire Slayer #1 sells out at Diamond.......Atomic Comics at PV has 0 copies.....Atomic Comics in OKC has 5 copies.....The Isotope in SFC has 0 copies.....MidTown in NYC has 3 copies......SpazDog Comics in PHX has 0 copies (they actually have more than zero).....Is it really sold out because it is sold out in this case in the Western/Southwestern states? 

Case Two:  There have been books that go to Second Printing with First Printings still available at Diamond.

when diamond reports a sell out, it refers to how many they have leftm, like when a record goes gold, it means that stores have bought enough copies from distributors to certify it as such, it has nothing to do with what is on store shelves, that number is indeterminable, un;ess every store in the world reports to the publisher

Record sales reporting is similar to Comic Books, but Books actually report actual sales using Bookscan, so they could track whether a book has "sold through" it's intial printing.  Should comic books follow the Bookscan model or the Record Sales model?  Does the way the comic book industry determine a "sell out" create undue customer buying frenzy and price pressure like Captain America selling on Ebay for $60 for the McGuiness variant and $120 for both covers.

No, what causes the price hike is people who have never read a comic in their whole life buying a ton of copies so real fans can't get their hands on them. Speculators are evil evil people.

diamnod reports a product sellout, when the product is (get this) sold out, & as for making a new system for determining weather a store has the product your looking for, years ago a gentleman by the Alexander Graham Bell created one, I like to call it... the telephone.
